With the blogging competition long gone, I've cleared my posts, making room for updates regarding action I'm taking on this very important issue. There have been discussions in passing on whether or not Senator McCain is eligible to be president, but not much has been done. I filed a claim in Federal District Court on March 14, 2008, asking the court to rule on his eligibility. I've taken the position that he is not eligible. Since my filing, I was referred to a similar filing on March 6, 2008 by Andrew Aames which asks the court for declatory relief. It seems to me the most dangerous aspect of this issue is that the Democrats could use McCain's citizenship as a fail-safe if he wins the general election. Should Hillary then challenge his eligibility, she could possibly be declared president. I believe the only way to avoid a potential post-election challenge is by mounting a pre-election challenge.
I'm not an attorney, but I've written the complaint on my own. My research was via internet as opposed to a law library. Fortunately due to the interest in this subject, a number of discussions pointed me to Supreme Court cases, ancient statutes and the manual of the State Department. I believe that by all authorities, Senator McCain is not eligible and I've asked the court to find Senator McCain ineligible to the Office of President and order the Republican National Committee to nominate a candidate who is eligible. If the court finds McCain eligible, at least that would stave off a Democratic win through the court. They tried it once, why wouldn't they try it again?
